About The Group: CCWV's attorneys have represented individuals in the area's appellate courts for many years. Many of our attorneys have appeared before the Court of Appeals and the Supreme Court of Virginia. Several of our practitioners have argued appeals in the U.S. Court of Appeals for the Fourth Circuit. We have handled appeals in civil, criminal, and domestic disputes involving cutting-edge legal issues.

The United States Court of Appeals for the Fourth Circuit

The Fourth Circuit Court of Appeals typically sits in three-judge panels when reviewing cases. CCWV's attorneys have regularly appeared before the Court in cases ranging from libel disputes to criminal matters. CCWV's attorneys provide their clients with the creative, thoughtful, aggressive, and experienced advocacy required to succeed on appeal.

The Supreme Court of Virginia

The Supreme Court of Virginia has discretion over which cases it chooses to review. Therefore, appealing to this Court typically is a two-step process. You must first persuade the Court to accept your appeal or issue a writ of error. Due to Virginia's burgeoning case load, the Supreme Court of Virginia only chooses to hear certain cases. Therefore, petitioning for a writ of error requires thorough analysis of each case, carefully sculpting each issue to present to the Court, and persuasive reasoning that convinces the Court that our client's case is one of the few that should be reviewed by the Court. Unlike the United States Supreme Court, the Supreme Court of Virginia allows parties to present a ten minute argument in support of their petition to a three Justice "writ panel." It only takes the vote of one Justice to grant an appeal. CCWV also can assist clients in opposing the granting of an appeal. After a writ of error is issued, presentation of an appellate case requires careful reasoning, creative arguments, and a knowledge of the bench. Appeals are argued to the entire Court of seven justices.

The Court of Appeals of Virginia

The Court of Appeals of Virginia primarily hears domestic relations, criminal, and worker's compensation appeals. The Court sits in rotating panels of three judges in different areas of the state. CCWV attorneys appear before the Court of Appeals of Virginia. While domestic relations cases have a right to appeal, criminal cases often require the Court to grant permission for an appeal. CCWV is fully familiar with the Court and has assisted clients with dozens of appeals in domestic relations and criminal cases.
